Terms of Service

Effective date: 30 July 2026

Please read these Terms carefully before using SiteFlow. Both Bahasa Melayu and English versions are provided; in the event of any inconsistency, the Bahasa Melayu version prevails.

1. Acceptance of Terms

SiteFlow (the "Platform") is a software-as-a-service (SaaS) for construction site diary, daily logging and project schedule management, operated by LUX ELECTRICAL ENTERPRISE (No. Pendaftaran: 003697691-U), No 12A-5A, Galleria @ Cyberjaya, Jalan Tenokrat 6, Cyber 5, Cyberjaya, 63000, Selangor. (the "Operator", "we", "us"). By registering an account, subscribing, or using the Platform, you (the "Customer", "you") agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

If you register on behalf of a company or organisation, you confirm that you have the authority to bind that company to these Terms.

2. Accounts & Registration

Each customer company is registered as a separate tenant account. The company administrator is responsible for managing user access under its account, ensuring registration information is accurate and current, and keeping passwords confidential. All activity under your account is your responsibility. Notify us immediately if you suspect unauthorised access.

3. Trial & Subscription

New accounts receive a free trial period as stated at registration. After the trial ends, write access (adding/editing records) requires a paid subscription at the price displayed in the Platform at the time of subscribing. Payments are processed through a third-party payment gateway (ToyyibPay/FPX).

When a subscription or trial expires, the account switches to read-only mode: your data remains safe and can be viewed and downloaded, but new records cannot be added until the subscription is renewed.

4. Acceptable Use

  • You may not use the Platform for any purpose that is unlawful under Malaysian law.
  • You may not attempt to access other tenants' data, probe system vulnerabilities without written permission, or interfere with the operation of the Platform.
  • You may not resell, rent or sublicense access to the Platform without the Operator's written consent.
  • You may not upload content that infringes the intellectual property rights of others or that contains malicious code.

5. Customer Data & Ownership

All data you upload or record in the Platform (daily logs, documents, photos, project schedules) remains your property. We process that data solely to provide the service to you, as detailed in our Privacy Policy.

You may download your data at any time while your account is active or in read-only mode. After account termination, we retain data for a reasonable period for recovery purposes before it is permanently deleted.

6. Artificial Intelligence (AI) Features

Certain Platform features (for example, importing a CPM schedule from a BQ document) use third-party artificial intelligence models to generate drafts automatically. AI-generated drafts are SUGGESTIONS only and must be reviewed and confirmed by a human before use. The Operator does not warrant the accuracy of AI output and is not responsible for decisions made based on unreviewed output. AI features are subject to usage limits under your subscription plan.

7. Service Availability

We make reasonable efforts to keep the Platform available but do not guarantee uninterrupted availability. Scheduled maintenance, third-party infrastructure provider outages, or events beyond our reasonable control may cause temporary interruptions. Your data is stored with backups in line with reasonable industry practice.

8. Fees & Price Changes

Subscription fees are as displayed in the Platform at the time of payment. We may revise pricing from time to time; any price change takes effect only for subsequent subscription periods and will be notified in advance. Refunds are governed by our separate Refund Policy.

9. Suspension & Termination

We may suspend or terminate access in the event of a material breach of these Terms, abuse of the Platform, or non-payment. Where reasonable, we will give notice and an opportunity to remedy the breach first. You may stop subscribing at any time; the effect of termination on your data is as set out in Section 5.

10. Intellectual Property

The Platform, including its design, code, logos and branding, is the property of the Operator and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Platform.

11. Limitation of Liability

To the maximum extent permitted by Malaysian law: (a) the Platform is provided on an “as is” basis; (b) the Operator is not liable for indirect losses, loss of profit, or loss of data caused by factors beyond our reasonable control; and (c) the Operator's aggregate liability for any claim is limited to the subscription fees you paid in the twelve (12) months preceding the claim.

The Platform is a management tool. It does not replace the professional judgement of engineers, contractors or authorities in any technical or contractual decision.

12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be displayed on this page together with its effective date. Continued use after a change takes effect constitutes acceptance of the updated terms.

13. Governing Law

These Terms are governed by the laws of Malaysia and subject to the exclusive jurisdiction of the Malaysian courts.
